International Agreements : Paris Convention

Note: The Registrar decided that “wholesale” and “retail sales” services must be

registered under Class 42 instead of Class 35, according to the Nice 8th Edition.

What is Registrable : Trademarks, Service Marks & Collective Marks

Priority under Paris Convention : Yes

Examination : Trademarks are examined as to its registrability and

against the existence of prior rights.

Publication : Yes, in the Official Gazette after acceptance

Opposition : Yes – within 3 months as of publication date (No extensions are permitted).

Time Frame for Registration : 12 months

Registration Term : 10 Years

Renewal Term :10 Years (Trademarks that have already been filed or registered

before December 1, 1999 will remain valid according to the old law (7 or 14 years);

they shall be renewed every 10 years thereafter)

Grace Period for Renewals : One year after expiration date

Use Requirement : Use of marks in Jordan is not compulsory for filing

applications or necessary for maintaining mark registrations in force.

Cancellation : Cancellations can be filed by any interested party who can establish

that the trademark was not actually used during the three years immediately

preceding the application for cancellation, or that there was no bona fide of using

the mark on the goods or services in respect of which the mark was registered.

International Agreements : Paris Convention

Novelty Requirements : Worldwide Novelty - novelty examination takes into

consideration any specification previously lodged with the Patent Office or any

patent previously registered.

Claiming priority : Yes

Examination : Yes – as to formalities and patentability.

Protection Period : 20 Years from filing date or priority date.

Publication : Yes – in the Official Gazette

Annuity Payments : Yearly from filing date

Grace period for Annuity payments : 6 months with fines.

Compulsory Licensing : If the owner of a patented invention in Jordan fails to

satisfy the stipulated working requirements of the country within three years, as

from the date of grant or

from the date of filing, the patent will be subject to compulsory licensing.

Working or nominal working of Patents/Inventions : Working of patents is an

official requirement - Alternatively, nominal working of a patent can be fulfilled

by publishing a notice in a daily newspaper every 2 years, inviting interested parties to exploit the concerned patent

Notes : The Law allows for the protection of chemical products relating to medical drugs, pharmaceutical compositions or food.

1- A power of attorney legalized up to the Jordanian Consulate.

2- A certified copy of the certificate of registration of the company or articles of association for a corporate person.

3- Assignment Deed duly legalized up to Jordanian Consulate.

4- Three copies of the specifications and claims in English and in Arabic.

5- Three sets of the formal drawings, if any.

6- A certified copy of the home application or registration or a certified priority document, if priority is to be claimed.

Change of Name and/or Address Recordal

1- A power of attorney legalized up to the Jordanian Consulate in the new name.

2- Certificate of change of name and address or extract from the home registry legalized up to Jordanian consulate.

Assignment Recordal

1- A power of attorney signed by the assignee, legalized up to the Jordanian Consulate.

2- An assignment deed signed by both assignor and assignee, legalized up to the Jordanian Consulate.

3- Name, address, nationality, and profession or nature of business of the assignee.

License Recordal

1- A power of attorney legalized up to the Jordanian Consulate.

2- License agreement document legalized up to Jordanian consulate.

Merger Recordal

1- A power of attorney legalized up to the Jordanian Consulate.

2- Merger document legalized up to Jordanian consulate.

Change of Name

A power of attorney legalized up to the Jordanian Consulate in the new name.

Change of Address

A power of attorney legalized up to the Jordanian Consulate with the new address.
